La terminología más exacta para hablar de los derechos del hombre, es la de ser «fundamentales», porque afectan a las dimensiones más básicas del ser humano y,por ello mismo, tienen que ser protegidos y garantizados por los poderes públicos. Se trata de derechos públicos subjetivos que son universales, imprescriptibles, irrenunciables e inalienables. Tienen límites filosóficos, de naturaleza sociológica o por razón de su finalidad. Poseen un fundamento iusnaturalista y no meramente positivista. Las primeras declaraciones de derechos fundamentales universales no aparecen (...) hasta finales del siglo XVIII, con carácter de individuales y personales, para, después, incorporar también derechos sociales, económicos, culturales y a los actuales de protección del medio ambiente, minusválidos, etc. Es lo propio del actual Estado social y democrático de derecho. More and more studies and research have found a positive relationship between the participation of young people in altruistic activities and helping others, but it is interesting to discover a relationship of that personal and vocational satisfaction in the preparation and training in a profession as important to society as teaching. For students who begin university studies related to teaching, their psychological well-being and motivation towards this activity are very relevant aspects to consider. The access to and attainment of a (...) University Degree with a great vocational character, such as that of Pre-School Teacher or Primary Education Teacher, can benefit the students who will be in charge. These future educational professionals will have adequate motivation and maintain a psychological well-being that, in short, will favour their personal balance and will impact their future students. This research aims to analyse the degree of psychological well-being and its relationship with the motivation towards starting the teaching career. A sample of 233 students and students aged between 17 or 19 years of age who are beginning university studies at the School of Education of Ciudad Real was selected. All participants are enrolled in the first year of the Degree in Pre-school and Primary Education. The relationship between the psychological well-being of the students and their motivation towards attaining a professional teaching career was analysed. Other variables such as age or sex were also taken into account. A quantitative study was carried out and the Ryff Psychological Welfare Scale and the Intrinsic Motivation Questionnaire (IMI) were used. Once the results were analysed, it was observed that there is a positive correlation between the perception of psychological well-being that the participants have and their motivation towards the beginning of university studies, whose professional focus is mainly direct teaching with the students of the early stages of Pre-school and Primary Education. There are also some significant differences, considering the age and sex of the participants. The vocational character of university preparation for the teaching profession may determine that students who begin their Degree studies have an important motivation towards the performance of their professional future. The present study aims to apply a program based on Hellison’s Teaching Personal and Social Responsibility Model (TPSR), traditionally used in Physical Education, to other educational subjects and examine the assessment of the teachers who carried it out during the 2018-2019 school year. The program was applied over eight months of one academic year and during at least 60% of the weekly class hours. Initially, 586 students participated, 429 being experimental subjects with 30 teachers, of whom 16 participated in the (...) interviews carried out, all of them being Secondary Education teachers. We used qualitative methodology through content analysis carried out with ATLAS.ti 7.1.3. The instruments used to collect information were semi-structured recorded group interviews. The conclusion is that the Personal and Social Responsibility Model can be applied to all subjects in the curriculum and is adaptable to any content and type of student body. As a basis for future research, we suggest the application of the model by all teachers involved in the same school year and the participation of students’ families. (shrink)

BackgroundMonitoring recovery–stress balance in sport is becoming more relevant to prevent training maladaptation and reach the optimal performance for each athlete. The use of questionnaires that identify the athlete’s recovery–stress state have much acceptance in sports due to reliability and useful, furthermore for its low cost. Identifying possible differences between sport modalities and sex is important to determine specific needs and possible intervention ways to keep a recovery–stress balance. The aim was to analyze the differences in the recovery–stress state and (...) mood states by sex and sport type during the competitive phase in young Mexican athletes. As a secondary objective, the psychometric properties of the Mexican version of the Recovery–Stress Questionnaire for Athletes were analyzed.MethodsA cross-sectional study was carried on with 461 athletes, 17.95 years old, from six sports disciplines. The RESTQ-Sport and Profile of Mood States were applied in a single moment. Differences by sex and sports modality were analyzed. RESTQ-Sport’s confirmatory factor analysis was performed after the stress and recovery theoretical structure of two stress and two recovery dimensions, and last, the concurrent validation with the POMS was carried on.ResultsSignificant differences by sex were found in the General Recovery and Sport Stress dimensions of the RESTQ-Sport as well as Vigor factor of the POMS, being higher for men; furthermore, both the Sport Recovery dimension of RESTQ-Sport and Cholera and the Fatigue and Depression factors from POMS also had differences by sport type, showing a less recovery and high stress for individual sport athletes. Goodness-of-fit indexes of the model for the RESTQ-Sport were acceptable. Pearson’s correlation between questionnaires was moderate.ConclusionThe recovery–stress state shows differences in the function of sex and sport modality. More special attention is suggested for women and individual sport athletes. The higher punctuation for men compared with women in sport stress dimension did not negatively affect the recovery–stress balance for male athletes. Finally, the Mexican context adaptation of the RESTQ-Sport provides a psychometric instrument suitable to assess the recovery–stress balance in Mexican athletes. (shrink)

El auge de los populismos de extrema derecha en el último tiempo amerita una indagación acerca de las características de la ideología reaccionaria. Una forma de aproximarse a esta es a través del pensamiento de sus principales autores. Nicolás Gómez Dávila es el mejor representante del pensamiento reaccionario en la filosofía latinoamericana, de modo que, a partir del análisis de algunos de sus escritos y siguiendo la propuesta de Richard Shorten para identificar lo reaccionario con base en tres pilares retóricos: (...) decadencia (_logos_), conspiración (_ethos_) e indignación (_pathos_), este artículo enfatiza algunas características propias de la ideología reaccionaria que la distinguen del conservadurismo, ilustrando esas diferencias con la retórica de algunos líderes reaccionarios que antecedieron a Nicolás Gómez Dávila en la Colombia del siglo XX. ABSTRACT The objective of this study was to determine the accuracy of a brief informed consent quiz to detect consent comprehension in individuals with cognitive impairment and to explore the degree to which cognitive domains and recent substance use, independently, predict comprehension. We performed a secondary analysis of two cross-sectional studies in individuals with substance use disorders. The ICQ total score was used as the index test and the Montreal Cognitive Assessment as reference standard in receiver operating characteristic curves. Two (...) independent multiple binary logistic regression models were performed using cognitive domains and days of recent substance use as predictors of ICQ outcome. We analyzed data from 215 and 251 participants, respectively. The ICQ showed moderate accuracy for major cognitive impairment and lower accuracy for mild impairment. Optimal cutoff score was set at 10 points or less for detecting comprehension difficulty. Lower scores in Short-Term Memory, Attention, Language, and Orientation increased the probability of failing the ICQ. A procedure including both the ICQ and cognitive screening measure could improve the accuracy of consent comprehension assessments. (shrink)

Based on the results obtained from primary education students—fifth and sixth graders—the aim of this work is to check the appropriate self-perceived behaviors during and at the end of the game. The study population was made up of 698 students from fifth and sixth grade in the Autonomous Region of Castilla–La Mancha (Spain). Data were collected through a questionnaire (scale) on the social skills of primary school students linked to the adequate skills when losing, the adequate skills when winning, and (...) the adequate skills during the game. Study results revealed that analyzed behaviors vary, depending on the moment of the game, being it more frequently during the development of the game than when losing or winning. (shrink)

The current literature shows great interest in the issue of gender diversity on boards of directors. Some studies have hypothesized a direct relationship between diversity and the value of the firm, but not many examine the intermediate mechanisms that may exert an influence on such relationships. We employ two stages of GMM estimation methodology to exhibit evidences of the relationship between gender diversity and compensation of top managers in the Spanish context. Results show that gender diversity positively affects the effectiveness (...) of boards—in terms of composition, structure, size and functioning—influencing a proper design of top managers compensation linked to company performance. Evidences suggest that legislative actions aimed at increasing the presence of women on boards of directors are justified not only for ethical reasons, but also for reasons of economic efficiency. Since the mid-1940s, when Maurice Merleau-Ponty gave a lecture on cinema at the Institut des Hautes Études Cinématographiques (IDHEC) in Paris, which was later published as “Cinema and the New Psychology” (Merleau-Ponty, 1977, pp. 89-105), film scholars have shown a lively interest in the relationship between philosophy and the seventh art. During his lifetime, his thinking influenced a number of important film theorists, from Amédée Ayfre, who was his student, to André Bazin to Henri Agel. More recently, in an Anglophone (...) context, and largely thanks to the pioneering work of Vivian Sobchack, his phenomenology has been a source of inspiration for thinking about the cinematic experience as an embodied vision, involving a deep exploration of perception. My own aim in this text is to encourage a slight but significant shift in focus as I explore what can be learned from Merleau-Ponty about the imagination, and ask how this might improve the understanding of film, particularly documentary film. Merleau-Ponty makes only passing reference to the work of the modernist film movements of the early 20th century in his own writings on film, but his phenomenology is relevant to understanding films made at a later date that engage with modernist discourse in a broadest sense. Esta reflexión plantea el problema que se da al querer dar cuenta del individuo, como existencia, de manera sistemática en el terreno de las tendencias lógicas de la ética. Sören Kierkegaard, será la guía para plantear que tal pretensión es dañina y se presenta como la imposibilidad para la afirmación de la subjetividad como vitalidad abierta siempre a las posibilidades que ofrece la condición humana. Para el desarrollo de este planteamiento trataremos de confrontar algunos planteamientos de Kierkegaard -sobre todo el (...) de la irreductibilidad de la existencia a sistema- con la eticidad hegeliana en particular, para mostrar cómo se revienta el postulado de un sistema de la existencia. Este reventarse se debe entender no como destrucción de lo dado sino como enfrentamiento de ello y conducción hasta sus últimas consecuencias donde se hace manifiesta la imposibilidad de encerrar la existencia en la estrecha posición de la ética como ciencia normativa, es decir como imperativo de comportamiento y direccionamiento moral de la subjetividad por los carriles del pensamiento que absorbe al ser y que postula a la razón como la directriz de todo proyecto vital. The widespread critical evidence surrounding executive compensation of listed corporations has boosted shareholder activism in recent decades. The say-on-pay (SOP) mechanism—a vote in which shareholders express their (dis)agreement with executive pay designs—is one of the corporate governance mechanisms that has led to this activism among listed firms. Merging agency and socioemotional wealth (SEW) arguments, this paper analyzes how effective SOP voting results are among listed family firms in terms of CEO compensation efficiency and equity. Using a sample of UK listed (...) firms from 2011 to 2018, our results show that SOP effectiveness is positively influenced by family ownership and is strongly moderated by family involvement in management and in governance as well as by family generation. Our findings stress the strong family effect and the ethical perceptions of family shareholders on SOP voting, showing how family participation in the firm encourages fairer and more aligned CEO compensation packages. SOP institutional and practical implications oriented to preserve shareholder value and family wealth are finally outlined. (shrink)

The article pays special attention to the numerous studies recently published concerning the Thomistic doctrines of being, personal being, participation, and the metaphysical concept of creation.

ABSTRACT The focus of this essay is Kant's argument in the Groundwork for the Metaphysics of Morals III that regarding oneself as rational implies regarding oneself as free. After setting out an interpretation of how the argument is meant to go, I argue that Kant fails to show that regarding oneself as free is incompatible with accepting universal causal determinism. However, I suggest that the argument succeeds in showing that regarding oneself as rational is inconsistent with accepting universal causal determinism (...) if one accepts a certain, plausible view of the explanation of events. RESUMEN El ensayo se enfoca en el argumento de Kant en la Fundamentación de la metafísica de las costumbres III según el cual considerarse racional implica verse a uno mismo como libre. Se interpreta la forma en que debe entenderse el argumento y se afirma que Kant no logra demostrar que considerarse libre es incompatible con la aceptación del determinismo casual universal. No obstante, se sugiere que el argumento sí logra demostrar que considerarse a uno mismo como racional es incompatible con la aceptación del determinismo casual universal, si se acepta una cierta versión plausible de la explicación de los eventos. En este trabajo se define formamente el concepto de representacion en química utilizando homomorfismos desde estructuras algebraicas, que llamamos sistemas de tipo C, en otras estructuras especiales de símbolos muy relacionados con los que son habituales en la qímica experimental. Para la definicion de los sistemas de tipo C se ha seleccionado un conjunto minimo de relaciones y funciones, que son necesarias para expresar proposiciones significativas en química. Tambien se define un lenguaje formal de primer orden adecuado a los sistemas (...) de tipo C, que llamamos L. EI resultado principal que se demuestra es que toda representación que verifica las mismas sentencias de L que un sistema de tipo C, es necesariamente isomorfo a él. Se concluye por lo tanto que puede existir un problema linguístico subyacente en la aplicacion que de la mecaníca cuántica se hace en la química teórica.The concept of representation in chemistry bas been formallv defined by means of homomorphisms from algebraical structures, which we call type-C systems, to some special sets of symbols which can be related to the symbols ordinarily used in experimental chemistry. A minimum number of relations and functions, which would suffice to express significant propositions in chemistry, have been chosen to define type-C systems. A first order formal language L adequate to type-C systems has been defined. It has been shown that each representation that verifies the same sentences of L as a type-C system is necessarily isomorphic to it. It is concluded that a systematic study of the representation problem in chemistry is in order because a deep language problem underlies the application of quantum mechanies to chemical problems. Se recogen en este volumen 6 de las ponencias presentadas en las XLVI Reuniones Filosóficas de la Universidad de Navarra (27 al 29 de abril de 2009); el resto de ponencias se publicarán en un próximo volumen de la Revista. Todas ellas, desde muy diferentes puntos de vista, hacen referencia al problema metafísico de la libertad, analizado tanto histórica como sistemáticamente, y cubriendo una amplia gama de problemas relacionados con la libertad.

Modal concepts (possibility, existence, necessity, contingency) acquire a capital relevance in Leibniz´s metaphysic, to such an extent that the whole set of particularities of his philosophical doctrines can be explained with a reference to the mentioned modal concepts.

En esta Presentación se indica que los artículos que conforman este número de la revista reunen 7 conferencias plenarias más una comunicación del Congreso Internacional sobre el pensamiento de L. Polo, La libertad trascendental, celebrado en la Universidad de Navarra los días 6, 7 y 8 de septiembre de 2012.

In this paper is studied the relationship between finite and infinite, creator and creature, in the metaphysics of Nicolaus of Cues; with this aim, the Cusano texts dealing with the transcendence of the Absolute´s infinity are highlighted, as well as the texts dealing with the inmanence of the finite in the Infinite. On the other hand, the relations of inmanence and transcendence, of finite and infinite, are made explicite through three kinds of affirmations or metaphores of Cusa: a) The Absolute (...) as Non aliud of the finite; b) The correlativity of the finite and infinite looks; c) Infinite intellect and human mind: relation as image. The paper finishes pointing out the impossibility of a reciprocal relation between finite and infinite, and emphasizing that the speculative horizon should be aimed at an analogy of the relation. El presente texto intenta establecer algunas bases de la filosofía social de Søren Kierkegaard. Para ello, toma el concepto de lo demoníaco, que se desarrolla en Sobre el concepto de ironía y El concepto de la angustia. En ellas, Kierkegaard señala las determinaciones de este concepto y lo enmarca dentro de las posibilidades de la subjetividad en su relación con los otros y consigo misma. En la primera, la figura de Sócrates da cuenta de lo demoníaco en el sentido del (...) surgimiento y repliegue de la subjetividad que no participa de los asuntos públicos de la polis griega. En la segunda, Kierkegaard trata la situación demoníaca como un estado psicológico donde la conciencia da cuenta de su relación forzada con el bien y de su mantenimiento en la posición del mal, que lleva al individuo a un estado de endemoniamiento caracterizado por su incomunicación, vacuidad y aburrimiento. Este diagnóstico establece, pues, que los demonios kierkegaardianos son tanto la imposibilidad de la configuración social de los individuos, como su posibilidad a través de la formación de una fuerte subjetividad. The impact of digital devices and the Internet has generated various changes at social, political, and economic levels, the repercussion of which is a great challenge characterized by the changing and globalized nature of today's society. This demands the development of new skills and new learning models in relation to information and communication technologies. Universities must respond to these social demands in the training of their future professionals. This paper aims to analyze the empirical evidence provided by international studies in (...) the last eleven years, related to the digital literacy of university students, including those pursuing degrees related to the field of education. Our findings highlight the fact that the digital literacy that is offered in universities to graduate/postgraduate students, in addition to treating digital literacy as a central theme, also focuses on perceived and developed self-efficacy. This is done by strengthening competencies related to digital writing and reading, the use of databases, the digital design of content and materials, and the skills to edit, publish or share them on the web, or applications aimed at treating digital literacy as emerging pedagogies and educational innovation. Secondly, we found studies related to digital competencies and use of the Internet, social networks, web 2.0, or the treatment of digital risks and their relationship with digital literacy. Evolutionary multi-objective optimization algorithms have been successfully applied in many real-life problems. EMOAs approximate the set of trade-offs between multiple conflicting objectives, known as the Pareto optimal set. Reference point approaches can alleviate the optimization process by highlighting relevant areas of the Pareto set and support the decision makers to take the more confident evaluation. One important drawback of this approaches is that they require an in-depth knowledge of the problem being solved in order to function correctly. Collective intelligence has (...) been put forward as an alternative to deal with situations like these. This paper extends some well-known EMOAs to incorporate collective preferences and interactive techniques. Similarly, two new preference-based multi-objective optimization performance indicators are introduced in order to analyze the results produced by the proposed algorithms in the comparative experiments carried out. This paper describes the academic personality of one Professor that spent all his life in the university: Polo. Professor of a lot of philosophy topics, investigator of the truth in its higher level, in the interdisciplinarity, etc. His courses, without repetitions, were always thinking aloud, paying his attention to the most important points. Most of his book are transcripts of his lessons. Using a single word, his knowledge can be described as a philosophy of Hope.

La Ley Orgánica General Penitenciaria (en lo sucesivo LOGP) en el año 1979 creó la figura del juez de vigilancia penitenciaria, dedicándole 3 artículos (76,77 y 78). Fueron necesarios dos años más, para que un Acuerdo del Consejo General del Poder Judicial de 9 de julio de 1981, pusiera en funcionamiento esa clase de juzgados, los cuales se constituyeron formalmente el 1 de octubre de 1981.

Se recogen en este segundo volumen de Metafísica y libertad otras 6 ponencias presentadas en las 46 Reuniones Filosóficas de la Universidad de Navarra, celebradas en abril de 2009. Al igual que en el anterior volumen (XLII/2-2009), se analiza en estos artículos la libertad considerada metafísicamente, tanto de modo sistemático, desde diferentes puntos de vista, como desde una perspectiva histórica, atendiendo a diversas tradiciones filosóficas.

Antecedents and reasons of the International Congress on the Philosophy of Spanish thinker Leonardo Polo (Pamplona, November 25-27, 1996) are explained in this paper. The text also underlines some points on the way Polo exercises the philosophical task.

Este trabajo se propone subrayar que la libertad no es sólo predicamental, sino que se inserta en el ser de la persona. En función de esa propuesta, se estudia la doctrina de dos grandes autores, Tomás de Aquino y Nietzsche, parangonando sus formulaciones sobre la existencia y el sentido de la libertad de la persona.
